DMCA Policy

Digital Millennium Copyright Act Compliance

1. Introduction

Aestora respects the intellectual property rights of others and expects its users to do the same. We comply with the Digital Millennium Copyright Act ("DMCA") and respond to notices of alleged copyright infringement that comply with applicable law. This DMCA Policy describes how copyright owners can report alleged infringements and how users can respond if they believe their material was removed in error.

2. Reporting Copyright Infringement (DMCA Notice)

If you believe that your copyrighted work has been copied and posted on our Service in a way that constitutes copyright infringement, please submit a DMCA notice to our Designated Agent. The notice must include the following information:

REQUIRED INFORMATION FOR DMCA NOTICE:

  • Physical or electronic signature of the copyright owner or authorized representative
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing, including URLs or other specific location information
  • Contact information of the complaining party (name, address, telephone number, email address)
  • Statement of good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
  • Statement under penalty of perjury that the information in the notice is accurate and that the complaining party is authorized to act on behalf of the copyright owner

3. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Aestora has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

⚠️ ACCOUNT TERMINATION ⚠️

Users who receive three (3) valid DMCA notices may have their accounts permanently terminated and be banned from the Service. We reserve the right to terminate accounts after a single offense in cases of egregious infringement.

4. Counter-Notice Procedure

If you believe that your material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notice. To be effective, a counter-notice must be a written communication provided to our Designated Agent that includes substantially the following:

REQUIRED INFORMATION FOR COUNTER-NOTICE:

  • Physical or electronic signature of the user
  • Identification of the material that has been removed or disabled and the location where it appeared before removal
  • Statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • User's name, address, and telephone number
  • Consent to jurisdiction in the federal court where the user resides, or if outside the United States, consent to jurisdiction in any judicial district where Aestora may be found
  • Acceptance of service of process from the person who provided the original DMCA notice or an agent of such person

Submit counter-notices to: Our support ticket system with the subject line "DMCA COUNTER-NOTICE".

5. Response to DMCA Notices

Upon receipt of a valid DMCA notice, we will:

  • Remove or disable access to the allegedly infringing material
  • Take reasonable steps to notify the user who posted the material
  • In cases of repeat infringers, terminate their accounts as described above
  • Respond to valid counter-notices by restoring the material within 10-14 business days, unless we receive notice of a court order

6. False Claims

ANY PERSON WHO KNOWINGLY MATERIALLY MISREPRESENTS THAT MATERIAL IS INFRINGING OR THAT MATERIAL WAS REMOVED OR DISABLED BY MISTAKE OR MISIDENTIFICATION MAY BE LIABLE FOR DAMAGES, INCLUDING COSTS AND ATTORNEYS' FEES.

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.

7. Copyright Agent Contact Information

For DMCA notices and counter-notices, please contact our Designated DMCA Agent through our support ticket system.

When submitting a DMCA notice, please include "DMCA NOTICE" in the subject line. Failure to include the appropriate subject line may result in delayed processing of your request.

Important: Please do not send DMCA notices to any other email addresses or contact forms, as this may delay our response.

8. International Copyright Issues

While the DMCA applies specifically to copyright issues within the United States, we respect intellectual property rights worldwide. If you are a copyright owner outside the United States, please follow the same procedure outlined above. We will respond to valid notices regardless of the country of origin, subject to applicable laws and treaties.

9. Protection of User Privacy

We respect user privacy and will only share user information as necessary to comply with legal obligations, including DMCA notices. When we receive a DMCA notice, we will forward it to the user who posted the allegedly infringing material. If you are concerned about your privacy, you may use an authorized agent to submit notices on your behalf.

10. Modifications to This Policy

We reserve the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting. Material changes will be notified via email or a prominent notice on the Service. Your continued use of the Service after any changes constitutes your acceptance of the modified policy.
